Pre-booking information
These General Booking Conditions (hereinafter General Conditions) will regulate the commercial relationship that arises between HERMANOS NICOLAU SA and the user or customer for the contracting carried out through the forms that HERMANOS NICOLAU SA makes available on its www.hotelbellamar.es.
Booking through HERMANOS NICOLAU SA's websites implies express acceptance by the customer or user of the pages of these conditions, as well as the conditions of use established for the user's browsing through the pages owned by HERMANOS NICOLAU SA.
These conditions shall apply without prejudice to the application of the relevant legal rules applicable in each case.
The General Contracting Conditions regulate the distance booking relationship between HERMANOS NICOLAU SA and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of 13 April, on General Contracting Conditions, Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.
HERMANOS NICOLAU SA reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions. These modifications may be made, through its websites, by any means admissible in law and shall be binding during the time they are published on the website and until they are not validly modified by subsequent ones. However, HERMANOS NICOLAU SA reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when it deems appropriate, announcing them in due time and form. The changes referred to in this section will not affect contracts made prior to the date of their publication.

HERMANOS NICOLAU SA informs that the booking procedure through its web pages is detailed in the corresponding section for the formalisation of the booking.
HERMANOS NICOLAU SA also informs users that they can access the conditions of use available on the website.
By booking with HERMANOS NICOLAU SA through its website, the user or customer expressly declares to know, understand and accept these conditions of use and the General Conditions. Likewise, the user declares to be of legal age, or emancipated minor, and to have the legal capacity to access the websites of HERMANOS NICOLAU SA and contracting through them. The user is responsible for treating confidentially and responsibly the identity and password obtained when registering as a customer, and may not transfer them to anyone else.
Once the booking has been made, the user will see the booking confirmation on the screen, which can be printed as proof of the booking.
The booking confirmation and the booking receipt (printout made by the user) are not valid as an invoice.
Operation of the Reserve
Booking offer and price reference
In compliance with current legislation and, in particular, with Law 34/2002 on information society services and electronic commerce, HERMANOS NICOLAU SA offers information on all possible reservations, their characteristics and prices in the corresponding section for the formalisation of the reservation. However, HERMANOS NICOLAU SA reserves the right to withdraw, replace or change the offers offered to its customers through its website, by simply changing their content. In this way, the products and/or services offered at any given time by the HERMANOS NICOLAU SA website will be governed by the General Conditions in force in each case. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the aforementioned products and/or services.
Indication of prices
Each possible reservation offered will indicate its price in euros and whether it includes VAT or any other applicable tax, as the case may be. The prices shown on the screen will be those in force at any given time.
Availability
The availability of the offers provided by HERMANOS NICOLAU SA through its website may vary depending on customer demand. Although HERMANOS NICOLAU SA updates the database periodically, the reservation requested by the customer may be full at that time. In this case, HERMANOS NICOLAU SA will send an e-mail to the customer informing him/her of the impossibility of the availability of the offer.

Full payment after booking
HERMANOS NICOLAU SA asks for the details of a credit card when booking through its website to guarantee the effectiveness of the reservation. We remind you that the establishment does not charge your credit card when making this reservation. The card is only used as a guarantee. The establishment reserves the right to check the validity of the credit card before the customer's arrival.
The invoice corresponding to the reservation will be settled at the time of check-in at the establishment.
Cancellation of reservation
HERMANOS NICOLAU SA has the following cancellation policy:
From the moment the booking is made, the customer may cancel it in the "cancellations" section of the website. Please note that it will not be possible to cancel bookings made 10 days prior to the start of the booking.
Withdrawal
According to the provisions of article 103 of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, supplies of services or goods made according to the consumer's specifications or clearly personalised, or which, by their nature, cannot be returned or are likely to deteriorate or expire quickly, are exempt from withdrawal.

Applicable law and jurisdiction
HERMANOS NICOLAU SA also reserves the right to bring any civil or criminal action it deems appropriate for the improper use of its website and content or for any breach of these conditions.
The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their disputes to arbitration or go to the ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard. HERMANOS NICOLAU SA is domiciled in ILLES BALEARS, Spain.
